Mutual assistance is the process countries use to obtain government to government assistance in criminal investigations and prosecutions. There are over 25 bilateral mutual assistance treaties to which Australia is a party.

In 2018, public submissions were invited on the topics raised in the consultation paper. The paper provided a short description of current pathways for recognition and enforcement of foreign judgments in Australia, and outlined key provisions and their rationale (including in relation to intellectual property matters) in the draft convention.
