New South Wales Crime Commission’s Annual Report for 2023-24 under the Proceeds of Crime Act 2002

National Cooperative Scheme on Unexplained Wealth
Annual Report for the period 1 July 2023 to 30 June 2024

There are two commitments relating to reporting the use of information-gathering powers under the National Cooperative Scheme on Unexplained Wealth:
- Section 20 of Schedule 1 to the Proceeds of Crime Act 2002 (Cth) (the Act) – The Commissioner or head (however described) of a police force or police service of a participating State or self-governing Territory must give the Minister a written report in respect of each financial year that contains information on the number and results of applications for production orders authorised under clause 1 and the number of notices to financial institutions issued under clause 12.
- Section 4.2 of the Intergovernmental Agreement on the National Cooperative Scheme on Unexplained Wealth (the IGA) – As soon as practicable after 30 June each year, relevant participating State or Territory party agencies must provide an annual report to the responsible State or Territory Minister on the use (if any) by the agency of the investigative powers reporting on the number of times that the powers were used by that agency. This will then be passed on to the Commonwealth Minister, who will table it in Parliament.
In accordance with section 20(1) of Schedule 1 to the Act and section 4.2 of the IGA, NSW Crime Commission (in consultation with NSW Police Force) reports the following:
